1. Who these terms are between

These terms govern your use of fushy.shop, operated by Fushy, the trading name of a sole trader established in the United Kingdom ("we", "us"), contactable at hi@fushy.shop. By using the site you accept them. If you do not accept them, please do not use the site.

2. This site is for adults

Everything we make is intended for adults and the site contains explicit product photography. You must be 18 or over to use it, and it must be lawful for you to view and buy adult material where you live. We ask you to confirm your age, and we rely on that confirmation.

3. Buying from us

This website is a shop window, not a checkout. All purchases complete on our Etsy shop, and the contract of sale is formed there. Etsy's terms and policies govern your purchase, including payment, delivery and dispute resolution. Nothing on this site forms a contract of sale, and prices or availability shown here may lag behind the live listing. The Etsy listing is always the authoritative version.

4. Our products

Every piece is modified by hand from an existing plush toy. Finishing, exact colour and precise measurements vary between items, and photographs are of the item or of previous work of the same kind. Measurements given are approximate unless we have confirmed something specific with you in writing.

Our products are for external personal use by the buyer. Use them sensibly, keep them clean as described on our process page, and stop using one if the insert is damaged.

5. Returns

Because of the nature of these items we are not able to accept returns or exchanges once an item has been received and unsealed. Under the Consumer Contracts (Information, Cancellation and Additional Charges) Regulations 2013, the usual 14-day right to cancel does not apply to sealed goods which are not suitable for return for health protection or hygiene reasons once unsealed. That exemption is what we rely on.

This does not affect your legal rights where an item is faulty, not as described, or not fit for purpose. If something arrives damaged or is not what was described, contact us and we will put it right.

6. Custom commissions

Custom work is quoted before anything is committed to. A commission is only accepted once we have confirmed the specification and you have paid through Etsy. Because custom items are made to your specification, they are not returnable other than where faulty.

7. Intellectual property

The text, photographs, design and code on this site belong to us. You may not reproduce them commercially without permission.

We are an independent maker. We are not affiliated with, endorsed by, sponsored by or licensed by Nintendo, Creatures Inc., GAME FREAK, The Pokémon Company, Hasbro, Sanrio, Jazwares or any other rights holder. Where we name a character, we do so descriptively, to identify the plush toy that has been modified.

8. Availability of the site

We try to keep the site up and accurate but we do not guarantee it will always be available, error-free or current. We may change or withdraw any part of it without notice.

9. Our liability

Nothing in these terms limits our liability for death or personal injury caused by negligence, for fraud, or for anything else that cannot lawfully be limited. Subject to that, we are not liable for indirect or consequential loss arising from your use of this website. Liability relating to a purchase is governed by the terms under which that purchase was made on Etsy, and by your statutory rights.

10. Links to other sites

We link to Etsy and to third-party reference material. We are not responsible for the content of external sites.

11. Contacting us

Email hi@fushy.shop or use our contact form. Because every purchase completes on Etsy, our full trader details are also published on our Etsy shop, and anything relating to an order is best raised through Etsy so it stays attached to your purchase.

12. Privacy

How we handle personal data is set out in our privacy policy and our cookie policy.

13. Changes to these terms

We may update these terms. The version published here at the time you use the site is the one that applies, and the date at the top shows when it last changed.

14. Governing law

These terms are governed by the law of England and Wales, and the courts of England and Wales have exclusive jurisdiction.
